Das Freiburger Märchen der Willkommenskultur
2014 stimmte der Freiburger Gemeinderat für die Errichtung einer Landeserstaufnahmeeinrichtung (LEA). 2018 wurde sie eröffnet, 2020 sollte der Vertrag zwischen Stadt und Land evaluiert werden. Im Dezember 2021 hat die Stadt dem Evaluationsbericht zugestimmt. Zu Beginn planten die Verantwortlichen eine maximale Verweildauer von 3 Monaten. Seitdem hat sich viel verändert. Bundesgesetze sehen heute für LEAs eine Wohnverpflichtung bis zu 18 Monaten, Arbeitsverbot, Sachleistungen und Residenzpflicht vor. Vorzeigemodell ist das Ankunftszentrum in Heidelberg, in dem Asylverfahren ohne reguläre Vorbereitung innerhalb von 24h abgefertigt werden können. Besuchsverbote, keine Selbstversorgung, keine Privatsphäre und willkürliche Security-Kontrollen - alles fester Bestandteil der Lagerlogik. Indem fast alle Freiburger Gemeinderatsfraktionen (ausgenommen Eine Stadt für alle und JUPI) die Evaluation in der letzten Gemeinderatssitzung durchwinkten, hießen sie diese Lagerlogik ausdrücklich gut. Wie jetzt? Freiburg, das ist doch „sicherer Hafen“? Vielleicht auf dem Papier! Tatsächlich hat die Stadt alles in ihrer Macht Stehende getan, um die Rechte ihrer Einwohner*innen in der LEA konsequent zu missachten. Auf den Antrag mehrerer Fraktionen, die Autor*innen eines Rechtsgutachtens zur LEA-Hausordnung anzuhören, folgte - nichts. Auf das Rechtsgutachten, eine Klage vor dem VGH, offene Briefe und Demonstrationen reagierte die städtische Sozialbürgermeisterei mit der Antwort „persönlich überzeugt zu sein, dass in der LEA alles mit rechten Dingen zugeht“. Diese Haltung schlug sich in der Überzeugung nieder, das Regierungspräsidium als Betreiber der LEA könne die vertraglich vereinbarte Evaluation allein durchführen. Zu keiner Zeit wurden Bewohner*innen oder NGOs einbezogen. Am Ende steht die Erkenntnis, dass es in der LEA eine Kleiderkammer gibt und sich Freiburg nicht nur als „sicherer Hafen“, sondern auch als Lager-City par excellence versteht.

Lager sind heute ein weltweit anerkanntes Mittel zur Unterdrückung von Migration. Sie folgten schon immer einer Abschreckungslogik: Wer es einmal in den Innenraum der kapitalistischen Zentren geschafft hat, wird festgehalten und isoliert. So sind die deutschen Aufnahmeeinrichtungen nicht nur Ausdruck einer repressiven Asylpolitik in der BRD, sie folgen einem globalen Trend der Verhinderung und Kriminalisierung von Migration. 

Indem die Stadt Freiburg die LEA mit der Zustimmung zur Evaluation gutheißt, regiert das repressive Migrationsregime bis in die Kommune fort. Und das, obwohl Kommunen als Orte, an denen Geflüchtete ankommen und leben, die Möglichkeit einer anderen Asylpolitik bieten. Mit der Zustimmung zur LEA entledigt sich die Stadt der Verpflichtung zur Folgeunterbringung von Geflüchteten in Freiburg und erteilt so einer eigenen Asylpolitik eine deutliche Absage. Angesichts immer restriktiverer Bundesgesetze ist das ein fatales Zeichen. Die Idee einer „Solidarity City“ wird sabotiert und Freiburg positioniert sich offiziell als Lager-City. Solange diese Ignoranz weitergeht, werden wir protestieren. Deswegen fordern wir vor der nächsten Gemeinderatssitzung: No more camps, we want homes.

Kommt mit Mundschutz und achtet auf die Mindestabstände!

The Freiburg fairy tale of "Willkommenskultur"
In 2014, Freiburg's municipal council (Gemeinderat) agreed to the establishment of a reception centre for asylum-seekers (Landeserstaufnahmeeinrichtung, LEA) in Freiburg. It was opened in 2018, in 2020 the contract between the city and the Land was to be evaluated. In December 2021, the city approved the evaluation report. At the beginning, the responsibles planned a maximum stay of 3 months. Much has changed since then. Federal laws now order a housing obligation of up to 18 months, a ban on work, non-cash benefits and obligatory residence for LEAs. The showcase model is the arrival centre in Heidelberg, where asylum procedures can be processed within 24 hours without regular preparation. Visiting bans, no self-supply, no privacy and arbitrary security checks - all an inherent part of the camp logic. By supporting the evaluation report, almost all of Freiburg's Gemeinderat (with the exception of those from Eine Stadt für alle and JUPI) explicitly approved this camp logic. 
 
But wait: Isn’t Freiburg a so called “Safe Harbour” for refugees? Maybe on paper! In fact, the city has done everything in its power to consistently disregard the rights of its inhabitants in the LEA. The request of several parliamentary groups to hear the authors of a legal report on the LEA house rules was followed by nothing. In response to the legal report, a complaint to the high court in Baden-Württemberg (VGH), open letters and demonstrations, the city's social welfare mayor's office replied “to be personally convinced that everything in the LEA is legally fine”. This stance was then reflected in the conviction that the Regierungspräsidium as operator of the LEA could carry out the evaluation on its own. At no time were residents or NGOs involved. In the end, the result is that there is a clothing store in the LEA and that Freiburg sees itself not only as a "Safe Harbor" but also as a Lager City par excellence.
 
Today, camps are a globally accepted strategy of suppressing migration. But they have always followed a logic of deterrence: those who have once made it into the interior of capitalist centres are detained and isolated. Thus, the German reception centres (LEAs) are not only an expression of a repressive asylum policy in Germany, they follow a global trend of making migration impossible and criminalizing it. 

By approving the LEA with the consent of the evaluation, the repressive migration regime continues to rule also on a municipal level. This is despite the fact that municipalities, as places where refugees arrive and live, offer the possibility of a different asylum policy. With the approval of the LEA, the city is relieving itself of the obligation to provide follow-up accommodation for refugees in Freiburg and is thus clearly rejecting an own asylum policy. In view of increasingly restrictive federal laws, this is a fatal sign. The idea of a "Solidarity City" is thus sabotaged and Freiburg officially positions itself as a Lager City. As long as this ignorance continues, we will protest. That is why we demand before the next municipal council meeting: No more camps, we want homes!
